Sheridan Ross serves as patent and trademark counsel to a generics pharmaceutical company headquartered in North America. In this role, the firm’s attorneys conduct opinion work on patents of innovator drug companies to provide the basis for our client to make Paragraph IV challenges to patents owned by innovator drug companies for early entry as a generic.
Among multiple projects, we have prepared a series of opinions concerning Orange Book*-listed patents for a topical dermatological medication and based on those opinions, our has filed an abbreviated new drug application. In addition, we developed an innovative monitoring and reporting tool that our client relies on in monitoring the patent status of innovator products. This tool has been described by the client as “establishing a new best practice.”
In recent years, our work has expanded to include global protection of the company’s pharmaceutical trademarks, which traverse dozens of countries. Because trademarks are such a key component of marketing and selling pharmaceuticals, our team works alongside marketing and in-house counsel professionals in equal turn to ensure the company is securing and pursuing the most valuable marks in each market, with an eye to the small differences pharmaceutical names can have when translated into multiple languages. Our attorneys truly partner with this, and other clients, with an eye on understanding their business goals in conjunction with the nuances of different countries and languages.
